FEES AND PAYMENT TERMS

Each participating party will pay in equal shares—unless otherwise agreed to by the parties or by contract—the hourly rate for mediation services, including time spent in preparation and attendance, phone calls and email communications, drafting of agreements or decisions, reporting to the court as required, and any requested post-mediation negotiations and follow-up. A minimum of three hours will be charged for half-day mediations, and a minimum of six hours for full-day mediations.

In the event of non-payment, all time and costs spent on collection efforts, including attorney fees and costs, will be assessed against the non-paying party. Powell Mediation reserves the right to request payment in advance.

IN-PERSON MEDIATIONS

The majority of mediations can be conducted remotely via Zoom. In the event that an in-person mediation is required or requested, facility charges will be paid by each party in equal parts, unless otherwise agreed to in writing or by contract. There will be no charge for travel time less than two hours. Mileage, airfare, meals, hotel, vehicle rental, required valet, and parking will be billed in equal shares to each party, unless otherwise agreed to in writing or by contract.
